Section 65
Special Provisions Regarding Absconding Persons
(1) In the case of a person who has not been arrested or who is absconding and does not appear in court if an arrest warrant has been issued in accordance with this paragraph, until he appears in court within thirty-five days from the day after the arrest warrant is issued, the following matters shall be as follows:-
(a) Such person is an incumbent official of the Government of Nepal, State Government, local level, constitutional body or any government office, organized institution wholly or partially owned or controlled by the Government of Nepal, State Government or local level, educational or academic institution or any other public institution. Or if he is an employee, he will be automatically suspended from his position,
(b) If the property of such a person is not frozen in accordance with sub-section (15) of section 58, the immovable property in his name shall be frozen in accordance with the same sub-section,
(c) If there is a need to renew an industry, trade or business or income tax registration related firm, industry, license etc. in the name of such a person or solely owned by such person, the renewal will automatically be postponed,
(d) Transactions of securities held in the name of such person shall be automatically suspended,
(e) The benefits such as salary, allowance, gratuity, pension which such person can get according to the law shall be automatically withheld,
(f) According to the prevailing law, the royalty benefit or benefit obtained by such person from intellectual property such as patent, design, trademark, copy right shall be automatically withheld,
(g) If it is known that there is a bank account in the name of such a person, the bank account shall be suspended if written notice is given to stop the operation of such account. (h) If written not to provide citizenship certificate, passport or land ownership certificate to such a person according to prevailing law, the relevant body should not provide citizenship certificate, passport or land ownership certificate,
(i) If such person is found to be outside of Nepal, or extradition can be made according to the treaty to which the Government of Nepal is a party or according to prevailing laws.If there is such a situation, the concerned country or related international organization can be requested to arrest him through diplomatic means, taking into account the seriousness of the crime.
(2) In order to give effect to the provision under sub-section (1), the court shall give notice thereof to the relevant authorities or agencies.
